What would you do if a simple lunch date with an old friend led to your arrest for a drug-induced homicide? This recently happened to my husband, Tom, and it's something that could happen to any one of us.

Some states, like Tennessee where we live, have adopted drug-induced homicide laws in which simply selling or handing over a substance to someone who then overdoses is considered murder. In such cases, it's common for the last person seen with the deceased to be charged.
In Tom's case, he was indicted by a grand jury. There's a saying, "A grand jury would indict a ham sandwich if the district attorney desired it". These charges are yet another instance of the misuse of prosecutorial discretion.

The principle of being "innocent until proven guilty seems lost. The rumor mill is in overdrive, and the absurdity of the tales I'm hearing is astonishing. It's reminiscent of the childhood game 'Telephone'; by the time the story reached the last person in the circle, it had transformed entirely. True to the adage, "A lie can travel halfway around the world while the truth is still lacing up its boots."
WHAT WE HOPE TO ACHIEVE:
My husband could be sentenced to 30 years in prison for a crime he did not commit. We've been advised that hiring a reputable criminal defense attorney is our best shot at proving his innocence. Additionally, the law in question is unjust. While I deeply sympathize with anyone who loses a loved one to an overdose, it's not right to label the unfortunate death of an adult drug user as a homicide. Nevertheless, today's culture tends to hastily assign blame.
